Terms of service
The terms that apply when you use We Track IT trackers and the platform.
Last updated: [date]
1. About these terms
These terms are between you (the customer) and We Fix IT (NT) Pty Ltd (ABN 25 164 167 891), trading asWe Track IT (“we”, “us”). They apply to our trackers, the We Track IT tracking platform, and our support. Your signed agreement with us sets out the full terms; this page summarises them. If they differ, your signed agreement applies.
2. The service
We provide access to the We Track IT platform atdashboard.wetrackit.com.au for the vehicles on your account, and — onInc. tracker plans — the trackers for those vehicles. We configure trackers and manage their settings and firmware remotely. SIM cards and mobile data for the standard reporting setup are included with trackers we supply. Support is by phone and email, 8:30am–5:00pm Darwin time on business days.
Tracking relies on GPS signals and mobile networks, which are not available everywhere or all the time. Trackers store records while out of coverage and send them later, but we can’t promise that every position or alert will be recorded or delivered in real time. The service is a fleet management tool. It is not an emergency, duress or life-safety service, and it doesn’t guarantee the recovery of a stolen vehicle.
3. Plans, prices and payment
- Prices are per vehicle per month, inc GST, as set out in your quote and on our pricing page. Prices are in Australian dollars and include GST.
- Inc. tracker plans run for a 36-month term for each tracker, from the day it’s activated. At the end of the term, the tracker is yours to keep.
- If you cancel early, the rest of the term is payable.
- After the term, the tracker keeps reporting month to month at the Service only rate, until either of us gives 30 days’ written notice.
- Published prices are for fleets of up to 20 vehicles. More than 20 vehicles? We’ll quote to suit your fleet.
- Inc. tracker plans are invoiced monthly in advance, on or about the 1st. The first month for each tracker is charged pro rata from its activation date. Invoices are due within 14 days, by direct debit or EFT.
- Service only plans: you buy the tracker outright ($250 inc GST for the FMM003) and pay theService only monthly rate.[Term and notice period to be confirmed.]
4. Trackers
- We own each tracker supplied on an Inc. tracker plan until the end of its term (with all fees paid), or until its early termination amount is paid. Then it’s yours.
- Until then, don’t sell, lend or tamper with the tracker. Only take out its SIM when we ask you to, and never use it in other equipment.
- On an Inc. tracker plan, if a tracker fails during its 36-month term because of a defect or fair wear and tear, we repair or replace it free. Lost, stolen or damaged trackers can be replaced for a replacement fee, and the monthly fee continues for the rest of the term.
- On a Service only plan the tracker is yours. If it needs replacing, a new FMM003 is $250 inc GST.
- Add trackers any time by emailing us. On an Inc. tracker plan, each new tracker starts its own 36-month term.
- You can move a tracker to another vehicle you own or operate. Update the vehicle in the platform or tell us, and take the tracker out before you sell or return a vehicle. Moving a tracker doesn’t change its term.
- Plug-in trackers are self-install. If you’d rather we fit them, we can install for a fee. You are responsible for fitting trackers safely, so they don’t interfere with driving or with the vehicle’s controls. Plug-in trackers should be fitted and removed with the ignition off.
5. Your responsibilities
- Use the service lawfully. In the Northern Territory, the Surveillance Devices Act 2007 (NT) makes it an offence to use a tracking device to find the location of a person, or of a thing such as a vehicle, without the consent the Act requires. You are responsible for getting any consent needed and for telling drivers that vehicles are tracked. See our general guide,Tracking your staff.
- Keep platform logins secure and only give access to people who need it.
- Tell us promptly about changes to your vehicles, or if a tracker is lost, stolen or damaged.
- Don’t try to interfere with, copy or reverse-engineer the platform or trackers.
6. Your data
Tracking data from your vehicles is your data. We hold and use it to provide the service, as described in ourprivacy policy, and we don’t sell it. Platform history is kept for 24months. You can export your data during the term and for 30 days after all services end; after that we may delete it.
7. Consumer law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by gaps in GPS or mobile coverage, by a vehicle not supporting a feature, or by a tracker being removed or tampered with. Your signed agreement sets out the full liability terms.
9. Suspension and ending the service
We may suspend the service if invoices are overdue or the service is being misused, after giving you notice where we reasonably can. Either of us may end the agreement as set out in your plan. On anInc. tracker plan: If you cancel early, the rest of the term is payable. To cancel a tracker early, give us 30 days’ written notice. The early termination amount is the Inc. tracker rate for each month (or part month) left in that tracker’s term, plus anything unpaid. Once it’s paid, the tracker is yours.
10. Changes
We may update these terms. If a change would materially affect you, we’ll tell you before it takes effect.
11. Governing law
These terms are governed by the law of the Northern Territory of Australia.
